Trenton Basement Flood Class Action Lawsuit

Class Action Filed: Trenton Flood Victims May Be Entitled to Compensation

Did your home in Trenton flood on August 23–24, 2023?
If you experienced basement flooding or a sewer backup and reported the incident to the City of Trenton, you may be eligible to participate in a proposed class action lawsuit seeking compensation for property damage and related losses.

Dubin Law, PLLC has officially filed a class action lawsuit against the City of Trenton. The lawsuit alleges that the City failed to properly manage its sewer systems, resulting in widespread flooding during the August 2023 storm. If your home was affected and you notified the City, this may be your opportunity to pursue justice and financial recovery.

On January 21, 2026, the Wayne County Circuit Court certified this case to proceed as a class action. The Court approved two classes:

  1. Notice of Claim Class – Any person and entity in the City of Trenton, Michigan, who timely filed a written Notice of Claim pursuant to MCL 691.1419 on Defendant City of Trenton claiming they sustained a sewage disposal system event on or about August 23-24, 2023.

  2. Complaint Intake Form Class – Any person and entity in the City of Trenton, Michigan, who timely notified the City of Trenton, orally or in writing, they sustained a sewage disposal
system event on or about August 23-24, 2023, and were not provided written instructions from the City of Trenton on how to comply with MCL 691.1419(1 ).

Important Deadline: If you wish to exclude yourself from the Class (opt out), you must do so by March 27, 2026. If you do nothing, you will automatically remain in the Class and be bound by the Court’s orders and any judgment, whether favorable or unfavorable. Take Action to Protect Your Rights

Under Michigan law, flood victims may be entitled to compensation if defects in the City's sewer system, which the City knew or should have known about, caused their flooding. However, state law imposes strict deadlines — and your right to take legal action can be permanently lost if you do not file the required documentation on time.

To determine whether you qualify for compensation and to ensure that your rights are preserved, we urge you to call us at (844) 382-4600 for a FREE CONSULTATION or complete the form below.
