The lawsuit alleges that the City failed to properly manage its sewer systems, resulting in widespread flooding during the August 2023 storm. On June 23, 2025, the Monroe County Circuit Court certified this case to proceed as a class action. The Court approved two classes:

  1. Notice of Claim Class – Any person or entity in the City of Monroe who timely filed a written Notice of Claim pursuant to MCL 691.1419 on the City of Monroe claiming they sustained a sewage disposal system event on or about August 23–24, 2023.

  2. Complaint Intake Form Class – Any person or entity in the City of Monroe who timely contacted the City of Monroe or the Monroe Metropolitan Wastewater Department claiming they sustained a sewage disposal system event on or about August 23–24, 2023, and for whom a Complaint Intake Form was completed.

Important Deadline: If you wish to exclude yourself from the Class (opt out), you must do so by November 13, 2025. If you do nothing, you will automatically remain in the Class and be bound by the Court’s orders and any judgment, whether favorable or unfavorable.
